so last night was shitty.  basically a friend of my neighbor came over to my house last night, yelling. i went outside to see what the comotion was all about.  i told him to get off my property and he just fucking cold cocked me upside the head. i tried to get back into the house, but he jumped me from behind, choking me. blood was everywhere and he pinned my up against my front door, ramming my head into it, punching me repeatedly.  there was about 10-12 of them on my front lawn, uttering death threats. over a fucking parking spot. 

i had no chance. finally, my wife was able to get out and helped get him off me and we were able to get free to call the cops.  they show up, take some statements and say there's nothing they can really do.  i say WTF?!?! look at me!  i was taken to the hospital in an ambulance for a CT scan and x rays.  i have multiple head bruises and fractures in my eye socket and jaw.  my wife suffered a broken hand in the scuffle.  i don't even have a mark on my hands. never got a shot in. i'm supposed to see a plastic surgeon this morning.  after i left, the cops told my wife to flush the weed down the toilet. i'm sure they didn't make the neighbors flush their beer.  they told me that they weren't going to charge him. fuck the police.

Damn wish I was there. THIS PISSES ME OFF!

There has to be something you can do in civil court. Call a lawyer if there was ten idiots one of them is going to say something stupid that will show planed intent.

thanks fellas.  ya shit's pretty fucked up.  i called the cops back with some more info and they are going to investigate it some more.  i haven't heard from the doctor yet and my wife just got back from the hospital for her hand.  she's got a compound boxers break. the doctor said it was "a spectacular break".  they had to set it for her there and sent her home in a splint as the swelling was too much.  she may have to have a pin or plate put in.  she's one tough gal.  pretty stoked that she came to help me out like that.  between the two of us, we were able to stop the fight and get him off the property.  i would have to say that without her coming to my aid, i would be seriously fucked up, or dead.

I'd take pictures and go to the police station with your wife while you both are bruised and broken up, ask to speak to someone higher up and get the details as to why you and your wife were assaulted with out with out provocation and nothing is going to be done about it.

i came here to bitch about an aching body part, but damn dtotherob, i'm sorry to hear abut what happened to you and your wife. i don't know how it works where you live, but here in texas if you get beat up/jumped on your own property you have some serious legal leway (like killing the fucker(s) on the spot during the scuffle) if that person has insurance you can also bleed that dry. hope all goes well man

That shit is absurd. All you gotta say is "Get off of my property!" three times in a row in NM, then you can shoot the motherfucker on the spot. I don't know who's to say you said it 3 times, but whatever. Then again you get punished more for cattle rustling here than manslaughter.

crazy.  i don't know if that's good or bad.  guns seem to be a lot harder to obtain here, so that probably wouldn't happen much.  there was a recent story about a guy and his wife who came home to some intruders.  they fought, and he was able to fend them off by hitting them with a hatchet.  even though he used the hammer end, he was charged with aggravated assault.  here, you can break into my house and cut your leg on the glass table and sue me.  basically, if you hit me, i can hit you back.  but i can't keep hitting you. because that's assault.  so fucked. 

i'm quite sure the neighbor and this guy instigated the whole thing. he wont talk.  and the last thing i want to do is go on his property.  i'm making some headway. we'll see.

Wow, that is beyond fucked. I hope you and your wife heal quickly, dtotherob, and I hope the cops get off their asses and do something. It blows my mind that you can be charged for aggravated assault on your own property, but if you go onto someone else's property and beat them halfway to hell over a fucking parking space the police won't even consider pressing charges. That's probably the single worst double standard I've ever heard.
